This website is operated by SilverfireUK. Throughout the site, the terms “we”, “us” and “our” refer to SilverfireUK. SilverfireUK offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
SECTION 1 - ONLINE STORE TERMS:
1.1 By agreeing to these Terms of Service, you are agreeing that you are over the age of 18.
1.2 If you purchase any items from our site for a minor you agree that the minor will be supervised with our products by a legally responsible person.
1.3 Children should be supervised at all times while wearing jewellery.
1.4 You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
1.5 You must not transmit any worms or viruses or any code of a destructive nature.
1.6 A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - GENERAL CONDITIONS
2.1 We reserve the right to refuse service to anyone for any reason at any time.
2.2 OUR PAYMENT PROCESSORS / CHECKOUT: our checkout is hosted by Shopify Inc located in Canada and the United States. They provide our ssl certificate to ensure that your payment is made via a secure server behind a firewall. By placing an order with us you agree that your information will be transferred to the United States. Please also refer to Section 4 of our Privacy Policy.
2.3 You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
2.4 Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
2.5 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
2.6 The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
2.7 These terms and conditions govern your use of the site and purchase of goods and services from the site. You will also find information on returns, your privacy and your security on other pages of the site and these pages shall be incorporated into these terms and conditions.
2.8 OUR STANDARDS: Our custom made jewellery items and our handmade items are made to a very high standard using good quality materials. We do not plate our custom made or handmade jewellery unless plating is requested. Our steampunk jewellery range is made from various materials including from actual watch parts and thus may contain sharp pieces. The various materials of our steampunk jewellery may include plated alloys, bronze and epoxy resins and glue; please contact us to enquire before placing an order if you are uncertain. Our steampunk jewellery is not recommended for children.
2.9 Sizes and Lengths: All of the sizes we give on our website are approximate. It is your responsibility to ensure that you have purchased the correct sizes. If you have purchased a ring or any other item and after receiving it you decide need a different size, you will need to cover your own postage costs for returning the original item and you will need to cover our postage costs for sending out the new item; international buyers this may include any customs, duties and/or tax charges (you will be responsible for all charges).
SECTION 3 DELIVERY AND CUSTOMS:
3.1 Please also see our delivery & returns page for information on timings and costs of delivery, and for our international customers please also see section 5 of these terms. We will try to deliver the goods or services within the times indicated but in general our dispatch and delivery times and dates are not guaranteed and are for guidance only.
3.2 For security reasons, we prefer to deliver the goods to your billing address where your credit/debit card is registered. Note that if you paid via PayPal we will only ship to the shipping address 'confirmed' by PayPal. We will only ship to the shipping address given at the time the order was placed. Please bear this in mind if you plan to move address, particularly if you purchase a made to order or a custom item that takes time to make. We always send our items by signed for delivery and/or fully tracked, see our delivery and shipping page for more information. You are responsible for making arrangements to receive the goods and making sure that someone is available to sign for them. If the goods are held at the post office or other delivery company's depot because no one was available when the goods were delivered then it is your responsibility to collect the goods within the specified time frames by the courier / post office. If your package is unclaimed and returned to us, we will either refund the cost of the item minus the 'actual' shipping fees, or you can pay to have it re-shipped. A refund will not be issued until we receive the items back. Note that the 'actual' shipping fee is usually the full cost that we incurred to package and post the item(s), and for international buyers this could also include customs or taxes.
3.3 Jewellery we post within the UK by Royal Mail Special Delivery is tracked and insured. Compensation entitlement for international shipping may vary depending on where you live so we recommend that you enquire with us prior to ordering, or you check with Royal Mail prior to ordering.
3.4 We do not offer compensation for delayed packages. It is your responsibility to notify us in a timely manner if you don't receive your package by the expected delivery date; we would class a timely manner to be within 10 calendar days of an expected delivery date. Outside of this timeframe we might not be able to help you.
3.5 International Orders if you choose an express or guaranteed delivery service you acknowledge that there is still the possibility that customs may hold your package which could cause delays, and this is beyond our control. In all cases, for buyers outside of the UK it is your responsibility to check that there are no customs restrictions on importing jewellery or gemstones to your country; if there are restrictions customs may destroy your package, for which we accept no liability for damage or loss. Please note that any duty or taxes incurred by your parcel being delivered overseas, you will be responsible for. It is your responsibility to pay any import costs, such as VAT, duties, and clearing fees; this also the case if you return an item to us. Failure to pay customs charges could result in your package being destroyed, for which we accept no liability for damage or loss. As the buyer you will be responsible for any return documentation and/or costs; failure to do so may incur UK customs duties which will be deducted from any refund. Refunds will only be given upon the safe return of items (please also refer to our refunds policy and section 5 of these terms).
3.6 For circumstances outside of our control it might not be possible for us to deliver to some countries. Should this happen we will contact you.
SECTION 4 ORDERS:
4.1 Orders shall be accepted at our sole discretion but are normally accepted once credit/debit card authorisation has been confirmed. Please keep your "confirmation of order" e-mail for your records. If for any reason, we are not able to fulfill an order, we will notify you by email. We always try to keep our site fully up-to-date and where an item is out of stock our site should prevent you from placing an order. However, it may be the case that an item has sold off-line (for example, at a market or festival, or over the phone) just prior to your purchase. In the event that an item is out of stock when you placed your order we will contact you and arrange a refund. In no circumstances will we be liable to you for additional amounts if we are unable to fulfil an order.
4.2 Orders for custom made items: if you have commissioned us to make a custom piece jewellery, we may at our discretion offer the first payment by way of a non-refunadable deposit and/or design fee. If we agree to this then the outstanding balance will need to be paid after the design or sculpt process prior to casting. Note that any deposit or design fee paid is non-refundable as soon as the process begins, which is usually upon receiving payment either in full or payment of the deposit and/or design fee.
4.3 Goods supplied are not for resale unless you have an approved wholesale account with us (currently we do not offer wholesale/trade accounts).
SECTION 5: ORDERS FOR DELIVERY OUTSIDE THE UNITED KINGDOM
5.1 If you choose to access our Site from outside the United Kingdom, you are responsible for complying with local laws, if and to the extent that they are applicable. We do not represent or warrant that any Service(s) on our Site is appropriate for use or available in locations outside of the United Kingdom, or that it complies with any legal or regulatory requirements of such other locations.
5.2 Delivery outside the United Kingdom may be subject to import duties and taxes. You will be responsible for these. We have no control over such charges and cannot advise you as to what they may be, although your local customs office may be able to assist. For deliveries outside the United Kingdom, you will be regarded as the importer and it is your responsibility to comply with all laws and regulations of the country in which the Services are to be delivered. Cross-border deliveries may be subject to opening and inspection by customs authorities. Please also refer to the 'delivery and customs' section above.
SECTION 6 CANCELLATIONS, REFUNDS, and WARRANTY:
Note that when we refer to our 'returns policy' we are referring to our Returns, Refunds and Cancellations Policy.
6.1 Please also see our 'Returns Policy'. If you realise you have made a mistake and want to cancel your order, please contact us as soon as possible and usually within 48 hours. We try to deliver your items quickly and it may not be possible to stop your order. We will not be able to cancel your order if it is for a custom made or made to order item or personalised items.
6.2 We do not accept returns or offer refunds on earrings due to hygiene reasons.
6.3 Under current UK Regulations you can cancel an order fourteen days from receiving your goods. This does not apply to custom made goods, made to order items or personalised items, or if we are providing another service such as a repair or a design process, we cannot cancel your order of these items once the order has been placed. Please refer to our ‘Returns, Refunds and Cancellation Policy’ for further information.
6.4 As per Returns Policy we also do not offer refunds for custom work once completed or for completed made to order items, but should you receive a defective item or if we have made an error then we will work with you to try to rectify the problem. Please also see section below 'Defective or Damaged Items and Warranty.'
6.5 Personalised and/or custom made items and 'made to order' products cannot be returned or exchanged unless we agree there is a manufacturing fault. It is the buyers responsibility to take correct measurements.
6.6 Returning non-faulty sale items or items purchased under a discount code offer: If you change your mind about a product purchased in one of our sales or with a discount code, you are not entitled to a refund but we may be able to exchange it at our discretion.
6.7 Goods returned after 14 days may incur a 15% handling charge. We reserve the right not to accept returns after the statutory returns period.
6.8 DEFECTIVE OR DAMAGED ITEMS & WARRANTY
(a) Should you receive an item that is damaged or not what you ordered, please contact us as soon as possible (within 48 hours) so we can help to resolve any issues. Please also refer to our refunds policy. For most of our jewellery we offer a replacement or repair service for jewellery from stock purchased from us that develops a manufacturing fault within the first 6 months of the order. For our custom made items and items made to order and handmade by us at our workshop we offer a free repair within the first 12 months of receipt if the item develops a manufacturing fault; all of our items handmade by us are clearly labelled as such either within the items title or within the item description. If you have any queries please get clarification from us prior to making a purchase. In house repairs are usually completed within a 15 working day turnaround.
(b) WARRANTY: jewellery from stock (jewellery not made by us) has a warranty for the first 6 months from the date that you receive the order (the delivery date). For jewellery handmade by us, made to order, and Custom Made Jewellery, we offer a full 12-month warranty on workmanship, which commences from the date of receipt (the delivery date). All jewellery handmade by us and our made to order items are clearly labelled as such on the items webpage.
(c) Any third party repair or alteration of the item voids the warranty. Warranty is also void if items have been damaged by careless handling, normal wear-and-tear, misuse, or damaged during transit and delivery.
6.9 All items that are returned as faulty are assessed by us, and items displaying damage as set out in 6.8(c) are not considered to be manufacturing defects and as such the items will not be accepted as faulty; we may offer a repairs service for such items and there is usually a small charge for this service to cover the cost of the repair along with any shipping costs incurred. International buyers if you need to return an item to us for repair you will be responsible for all return shipping charges, including any customs fees, duties or taxes. If we determine that there was a manufacturing fault we may at our discretion reimburse reasonable shipping costs as long as the costs are agreed with us prior to returning. Tarnishing of silver is a natural process over time and as such it's not a manufacturing defect.
SECTION 7 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
7.1 We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information, which if uncertain you should seek clarification. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
SECTION 8 - MODIFICATIONS TO THE SERVICE AND PRICES
8.1 Prices for our products are subject to change without notice; and our prices can sometimes fluctuate as we are dependent upon many factors such the price of silver, wholesale costs, etc .
8.2 We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
8.3 We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 9 - PRODUCTS OR SERVICES (if applicable)
9.1 Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Terms and our Return Policy.
9.2 We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. Please also note that the sizes of images are often enlarged on our site to show the detail - always refer to the measurements and sizes stated on the individual product listings; and read the item descriptions.
9.3. Presentation Gift Boxes: most of our jewellery will come with a presentation box. These boxes are not meant for long term storage of jewellery. Some of the boxes may have silica gel packets inside (do not eat), Slica gel packets are said to reduce moisture and can help lessen the tarnishing process of silver.
9.4 We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
9.5 We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. However, we do strive to meet customer satisfaction.
SECTION 10 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
10.1 We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors; or where we suspect fraud.
10.2 You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, so that we can complete your transactions and contact you as needed.
SECTION 11 - OPTIONAL TOOLS
11.1 We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
11.2 You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Also see Third Party links below.
11.3 Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
11.4 We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

12.1 Certain content, products and services available via our Service may include materials from third-parties.
12.2 Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
12.3 We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Where appropriate we recommend that you read the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. Please also refer to our privacy policy.
SECTION 13 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
13.1 If, at our request, you send certain specific submissions (for example contest entries or comments in general about our service and products) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. 13.3 You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. 17.4 In no case shall SilverfireUK, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. 18.1 All materials, including images, designs, site layout, illustrations, written and other text or script that are part of this site together with all software compilations, underlying source code and software in the site are protected by copyright, trade mark, design right, and/or other worldwide intellectual property rights and are owned or controlled by or licensed to SilverfireUK. All rights are reserved.
18.2 All images on our site may not be used without prior express written permission from us. Our images must not be copied or altered in any way.
18.3 We reserve the right to use images from custom orders for the purpose of advertising our services to others.
18.4 If you are supplying a design to us it is your responsibility to ensure that you are not breaking any copyright or design right laws. We take it in good faith that any design supplied by you that you commission us to make is not in breach of copyright laws or design rights.
18.5 Most of the jewellery on our site is protected by design right and copyright law and legal action will be taken against any form of copying.
18.6 You should not use any of our content without obtaining our express prior written permission.

20.1 These terms and conditions are governed by English law and by using our website and/or placing an order you agree to submit to the exclusive jurisdiction of the courts in England.
